Saisir la justice sans la connaître
Résumé
Focusing on parties who consider themselves aggrieved following the purchase of a tax-exempt product, this article studies the ordinary relationship with the court and how this can evolve, before, during and after a hearing. The confrontation with lawyers and the technical nature of the proceedings tend to reinforce the feeling of dispossession among ordinary people. The succession of experiences up until the judgement nonetheless reveals the various social uses of the law and the variable relationships to the judicial institution.
Centré sur les justiciables s’estimant lésé·es suite à l’achat d’un bien défiscalisé, cet article étudie le rapport ordinaire à la justice et son évolution – avant, pendant et après l’audience. La confrontation avec les avocat·es et la technicité de la procédure tendent à renforcer le sentiment de dépossession des profanes. La succession des expériences jusqu’à la réception du jugement révèle néanmoins des usages sociaux différents du droit et des rapports variables envers l’institution judiciaire.
